This application will be confirmed within three working days of receipt. Club Nàutic S’Arenal reserves the right to modify the dates for technical reasons or bad weather. In these cases, the Club will inform Club members/clients as soon as possible of any changes..

The USER is interested in hiring the Travelift/dry dock facilities for the vessel whose details have been registered in Club Nàutic S’Arenal’s administration department, according to the Regulation of Interior State and the Statutes of the Club, of which the USER has received a copy and he/she declares to understand and to accept in his/her totality as an integral part of this contract for vessel lift-outs/dry dock stays. Both parties subscribe equally to the Dry Dock Regulations as written on the reverse. As a token of conformity, both parties sign the present contract, by exemplary duplicate and to a single effect.

The working areas are for the use of vessels where maintenance and/or repair work is permitted. The winter storage area is for parking vessels for long periods of time. NO work which produces waste matter is permitted in this area. It is advisable not to carry out work which may upset other Club users at weekends or on bank holidays. USERS OF THESE AREAS, BOTH CLUB MEMBERS AND COMPANIES, MUST COMPLY WITH THE RULES AND REGULATIONS 1.- The person and/or company who carries out work in the dry dock area will be responsible for any inconvenience, waste matter or damage caused to the users of the port, or to the vessels situated on land or in water, as well as any damage caused to the harbour installations. It is completely prohibited to sand down iron or stainless steel vessels, as well as the use of a spray painting gun without the permission of the Port Headquarters. 2.- It is completely prohibited to pour/spill contaminant products, hydrocarbons, etc., in both dry dock areas as well as into the sea. In the case of an accidental spillage, it will be the responsibility of the company or person who carried it out, to bear the cleaning expenses as well as any compensation caused by damage to the club or to third parties. In any case, the owner of the vessel will be the subsidiary responsible for paying the afore-mentioned expenses. 3.- The harbour master or authorized Club personnel are the only authorized person/s to move the subjection blocks of vessels in the dry dock area. 4.- If for any reason , any type of cover is mounted over vessels under which to carry out work, painting or similar, these will be installed under the absolute responsibility of the company installer, and they should be removed in time if bad weather is forecast to avoid endangering the security of the vessel in question or that of its neighbours. 5.- Club Nàutic S´Arenal has made available containers for selective collection of solid and liquid waste. It is the responsibility of the Club members, clients and businesses to make good use of them. 6.- It is the responsibility of the person and/or business that carries out work in the dry dock to clean, on a daily basis and at the end of the stay, the area where the vessel is sitting, as a result of any work carried out (tins of paint, paintbrushes, cloths, oils, spare parts, etc.). Breach of said obligations will involve paying for the cost of the withdrawal of waste matter and cleaning. In any case, the owner of the vessel will be the subsidiary responsible for paying the afore-mentioned expenses. 7.- It is obligatory to sand with a sand vacuum machine. The Club will make available to clients, with the exception of businesses, the necessary machinery for said sanding, in the cases which are authorized, subject to payment in advance of the daily amount established by the board of directors. 8.- It is categorically prohibited to use explosives or dangerous materials due to the high inflammable risk, except for solvents or chemical products used in the normal progress of work. 9.- Businesses as well as clients and Club members who intend to use the dry dock areas must sign a working area and winter storage contract of agreement, meaning that one is obliged to comply with the present Regulation. 10.- It excludes the vessel’s custody duty and the goods onboard. The user assumes the responsibility of shutting the vessel so as to avoid thefts and robberies. 11.- The user authorizes the Club explicitly that in case of nonpayment and in the case that the vessel is in the dry dock area for a period of six months more than predicted, and no request for a prolonged period is solicited, the Club will continue the following procedure: - The Club will notify that if the vessel is not withdrawn within a month of notification, the Club will transfer the vessel to a storage area, and all expenses for this will be charged to the user. - Once the vessel is moved to the storage area, it will be considered as abandoned, and if after a period of 6 months has elapsed after entering the storage area it has not been withdrawn, or payment of expenses has not been made, the Club will proceed to scrap the vessel, with all expenses of this process being charged to the user. - Likewise, in these cases no services will be given on behalf of the Club. PARTICULARS FOR COMPANIES The authorized working hours in the working area are the following: From Monday to Friday from 8.00am until 20.00pm. Saturdays from 9.00am until 15.00pm. During the months of July and August the established working hours are Monday to Friday from 9.00am until 19.00pm. Saturday mornings from 9.00am until 14.00pm. Everyone who carries out commercial or industrial activity, or services, inside the area, should present every 6 months (April/October) the following documentation: - The last receipt of payment of business tax or its equivalent. - Certification that they are up to date with payment to the Social Security or a copy of the last TC1. - An up to date civil responsibility of damages to third parties policy, with a minimum amount of three hundred thousand Euros (300,000 €), or one as determined by the board of directors, as well as the last receipt of payment. - Relation of the company’s employees along with copies of their respective D. N. I. If these are not Spanish citizens, a copy of their residence certificate and a copy of their Social Security registration. - They must be up to date with payments of Club fees. - Certificate of the AEAT (Tax Agency) to be fully aware of the tax obligations. Rights of the businesses that are registered in the Club: - Utilization of exterior installations of the Club, to carry out labour activity, within the schedule stipulated. - The right for each company registered to park two vehicles within the Club's installations. If a company requires parking facilities for more vehicles, from the third vehicle onwards, they must pay at the parking meter, within the dry dock working hours stipulated. - As the Club does not have individual control for water and electricity consumption and electricity for companies, their respective expenses will be included in the rate mentioned. (only when a rational consumption is carried out) - Included in the charge for businesses is the right to use sanitation facilities, social localities, etc., during the dry dock working hours as stipulated. - The Club will make use of their right of admission to those businesses that do not comply with the afore-mentioned requirements. - The Club will publish a list of the companies registered to work in the Club's installations on the notice board..
